Which by default makes it not tinfoilhat-ish. It's in the TOS, making it legal of course. But that doesn't make it reasonable, because almost nobody reads those terms. Getting a 40-page document to accept when you install your OS and then having Cortana on by default is really quite shitty. I think what Google does with Google Now is far more reasonable. It's off by default and the first time you access it you enter a setup where it tells you what it is, what data it collects along with a specific TOS agreement that you need to accept in order to use it.
