NCsoft's copyright complaint to the NY district court is public, you can take a look at it if you want. Basically they stole:

Yeah, it could have been stolen after L3 was released. However, in that case NC soft's shares wouldn't have dropped and they wouldn't have lost millions of dollars. Take a look at WoW for example. Everyone can copy and did copy WoW, but had they stolen the ideas before WoW came out it would have never gotten close to 11Million players. There's a LOT of money being lost the moment your ideas get stolen and sold.
Races are almost exactly the same. Even the proportions are the same. And do you know what that means? that means they can use the same exact same skeletons for the characters.
And the colours/lights/graphics are possible due to the extensive changes of the changes to the engine.

it's not just code stealing, the main ideas and concepts have been stolen as well. Races, looks, movement mechanics, classes, etc.
also, one thing is the game doing well or not, another is the court simply shutting it down.
