Well, murder is about killing a human being, not about killing "any living thing" (unless you're full-on vegan). Plus, if you're actually going to talk "scientifically", life/death is an arbitrary set of distinctions in which human faetuses without a functioning heart nor brain don't count as actually living (not because of the lack of functional brain/heart per se, but because they're biologically not different from an organ or a tumor).


That said, I can't see a way to actually enforce abortions on parents "without a licence" without disregarding a good bunch of human rights.

Murder is the unlawful killing of a person, usually premeditated. If it's legal, it is not murder, by definition. And this all assumes a fetus is a person, rather than simply human (those aren't the same thing).

Well, IDK how it works all over the world, but here in Argentina the Human Rights go above our own Constitution. And HHRR kinda say that under no circumstance killing a person/human can be legal (at least to my best knowledge).

And this all assumes a fetus is a person, rather than simply human (those aren't the same thing).
I'd want to know what would be that difference. I guess by what I understood that a fetus, while being a human being, is not a person if it lacks a functioning brain/heart.

The discussion on abortions is nice but I'd like to hear some more on how to enforce the licenceless-childbirth "punishment". Like, that's the main concern that stems from the OP.

In the US, killing can be legal, obviously, because it's still legal to kill someone as a punishment for their crimes. Also, in many places outside of the US, a person can choose to die and be assisted in that. In which case, the doctor has killed them, legally. If the killing is legal, it is, by definition, not murder. I hate that people throw that word around like it has no specific meaning. The moral rightness of the death is something else entirely.

Generally one has to have a sense of self to be a "person" in a philosophical sense, which is why it's arguable whether a fetus is truly a person or not. It's really very hard to argue or prove, for either side, that a clump of cells (which is the general state when most abortions are performed in the US) has or hasn't as much sentience as its mother.
