There actually was a case in which this happened not too long ago, in which a man went to rob a store and the lady who owned it caught him, tied him up in her office, left him there and raped him for several days. Absolutely no charges were filed against HER, while he obviously went to jail for attempted robbery. But just think for a second. If it was the other way around? If a MAN tied a WOMAN up, after she failed to rob his store, and tied her up and raped her for several days. You think he'd just be able to walk away from that? Absolutely not.
