Yeah but the thing is if there's any copyrighted material on the site, regardless of whether it's user uploaded or breaks the site's rules, it can still be immediatly shut down with no warning.
And think about it. There's at least some copyrighted stuff on every site on the internet.

1) Dunno
2) Pretty much 100%. There's too much money behind it for it not to pass.
3) As far as I know only American sites, but most popular/good websites are hosted in the US.
